These Terms of Use (“Terms”) govern your access to and use of the Fruitly mobile application (“Fruitly,” “App,” “we,” “us,” or “our”). By downloading, installing, accessing, or using Fruitly, you (“you,” “user”) agree to be legally bound by these Terms. If you do not agree to these Terms in full, you must immediately stop using the App and remove it from your device.
By using Fruitly, you acknowledge that you have read, understood, and agree to these Terms of Use and our Privacy Policy. These Terms apply regardless of the device, operating system, or platform you use to access the App. Your continued use after any updates constitutes acceptance of revised Terms.
Fruitly provides automated fruit identification using image recognition technology. The App is intended for informational and educational purposes only. Fruitly does not, and cannot, provide medical, nutritional, dietary, agricultural, food-safety, or health advice of any kind. You must not rely on Fruitly as a substitute for professional consultation, product labeling, or independent verification.
You must be at least 13 years old, or the legal age of majority in your jurisdiction, whichever is higher, to create an account.
You are solely responsible for maintaining the confidentiality of your account credentials and all activities under your account.
You agree not to share your login information, permit unauthorized access, or misuse the App in any way.
Fruitly reserves the right to suspend or terminate accounts at its discretion for violations of these Terms or misuse of the App.
When using Fruitly, you agree not to:
Upload, transmit, or share unlawful, harmful, or offensive content.
Interfere with or disrupt the App’s operations.
Reverse engineer, decompile, or otherwise attempt to derive the App’s source code.
Use the App for commercial purposes without our written consent.
We collect and process data in accordance with our Privacy Policy. By using the App, you consent to such collection and processing. You understand that:
Images you upload may be temporarily stored for analysis but are not shared with third parties without your consent, except as required by law.
No system is fully secure, and you accept all risks of data transmission and storage.
You may request deletion of your account and data, subject to applicable legal requirements.
All rights, title, and interest in Fruitly, including its software, algorithms, graphics, trademarks, and content, remain our exclusive property. You are granted a limited, personal, non-transferable license to use the App. You may not copy, reproduce, distribute, or modify any part of the App without our prior written consent.
Fruitly is provided strictly on an “as is” and “as available” basis.
We make no warranties, express or implied, regarding accuracy, completeness, reliability, merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App’s identifications or recommendations are correct, safe, or suitable.
We do not guarantee uninterrupted, secure, or error-free operation of the App.
To the fullest extent permitted by law:
Fruitly and its affiliates, owners, directors, employees, and partners shall not be liable for any losses, injuries, illnesses, allergic reactions, or damages of any kind (including direct, indirect, incidental, special, consequential, or punitive) arising from your use of or reliance on the App.
This includes, without limitation, harm resulting from:
misidentification of fruits,
purchase, handling, or consumption of any product identified by the App,
allergic or medical reactions,
spoilage, contamination, or mislabeling of foods,
reliance on the App for dietary, medical, or safety decisions.
You accept that you use the App entirely at your own risk.
By using the App, you expressly acknowledge and agree that:
Fruitly cannot determine freshness, ripeness, contamination, or allergen content.
You are solely responsible for verifying the safety and suitability of any fruit before buying, handling, or consuming it.
You must consult qualified professionals for medical, nutritional, or safety advice.
Any reliance on App results is solely at your own risk, and you release Fruitly from all related liability.
You agree to indemnify, defend, and hold harmless Fruitly and its affiliates, directors, officers, employees, licensors, and partners from and against all claims, damages, liabilities, losses, costs, and expenses (including attorneys’ fees) arising from or related to:
your use or misuse of the App,
your reliance on its results,
your violation of these Terms, or
your infringement of any rights of another person or entity.
We reserve the right to update or modify these Terms at any time without prior notice. Changes will take effect immediately upon posting within the App or on our website. Your continued use constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed under the laws of the United States of America and the State of California, without regard to its conflicts of law principles. Any disputes shall be brought exclusively in the state or federal courts located in Los Angeles County, California.
If any part of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full effect.
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Fruitly and supersede all prior agreements, written or oral, relating to the App.
